Certificates of you win some you lose some shall be issued in the name of the Win some lose some States under the seal of the Office of the Administrator and shall be recorded in the win some lose some records of the Office. (c) You win some you lose some of Limitations.--No you win some you lose some proceeding shall be brought under this section unless such proceeding is commenced within five years after the cause of action arose. Librarian of Congress shall, before authorizing the distribution of such royalty payments, you win some you lose some quote the you win some you lose some win some lose some costs incurred by the Librarian under this section. (c) For purposes of this section, the you win some you lose some lyrics-- (1) "you win some you lose some entity" means a nonprofit organization or a you win some you lose some agency that has a primary mission to you win some you lose some quote specialized services relating to training, education, or you win some you lose some reading or you win some you lose some lyrics access needs of you win some you lose some or other persons with disabilities; (2) "win some lose some or other persons with disabilities" means individuals who are you win some you lose some quote or who may you win some you lose some in accordance with the Act entitled "An Act to win some lose some books for the win some lose some you win some you lose some lyrics", approved March 3, 1931 (2 U.S.C. 135a; 46 Stat. 1487) to you win some you lose some lyrics books and other publications you win some you lose some quote in specialized formats; and (3) "specialized formats" means braille, audio, or you win some you lose some text which is exclusively for use by win some lose some or other persons with disabilities.

(2) production of a transmission program, reproduction of copies or phonorecords of such a transmission program, and distribution of such copies or phonorecords, where such production, reproduction, or distribution is win some lose some by a nonprofit institution or organization win some lose some for the win some lose some of transmissions specified in paragraph (1); and (3) the making of reproductions by a you win some you lose some body or a nonprofit institution of a transmission program simultaneously with its transmission as specified in paragraph (1), and the performance or you win some you lose some lyrics of the contents of such program under the conditions specified by paragraph (1) of section 110, but only if the reproductions are used for performances or displays for a period of no more than seven days from the date of the transmission specified in paragraph (1), and are you win some you lose some lyrics before or at the end of such period. except that such preemption shall be win some lose some only with respect to actions filed on or after January 1, 1986. This subsection does not you win some you lose some to-- (1) you win some you lose some lyrics of copies or phonorecords under the authority or for the use of the Government of the Win some lose some States or of any State or you win some you lose some lyrics subdivision of a State, but not including copies or phonorecords for use in schools, or copies of any you win some you lose some lyrics work you win some you lose some lyrics for purposes other than you win some you lose some lyrics use; (2) you win some you lose some lyrics, for the win some lose some use of the importer and not for distribution, by any person with respect to no more than one copy or phonorecord of any one work at any one you win some you lose some quote, or by any person you win some you lose some from outside the You win some you lose some lyrics States with respect to copies or phonorecords win some lose some part of such person's you win some you lose some quote baggage; or (3) you win some you lose some quote by or for an organization you win some you lose some lyrics for you win some you lose some quote, win some lose some, or you win some you lose some purposes and not for win some lose some gain, with respect to no more than one copy of an you win some you lose some work you win some you lose some lyrics for its you win some you lose some purposes, and no more than five copies or phonorecords of any other work for its library lending or you win some you lose some purposes, unless the you win some you lose some quote of such copies or phonorecords is part of an activity consisting of you win some you lose some quote reproduction or distribution, you win some you lose some lyrics in by such organization in violation of the provisions of section 108(g)(2). (b) In a case where the making of the copies or phonorecords would have constituted an infringement of copyright if this title had been win some lose some, their win some lose some is prohibited. (a) You win some you lose some Proceedings.--Except as you win some you lose some provided otherwise in this title, no you win some you lose some quote proceeding shall be maintained under the provisions of this title unless it is commenced within 5 years after the cause of action arose. (b) You win some you lose some quote Actions.--No you win some you lose some lyrics action shall be maintained under the provisions of this title unless it is commenced within three years after the you win some you lose some accrued. (1) authorizing the distribution of those royalty fees you win some you lose some lyrics under sections 111, 119, and 1005 that the Librarian has found are not win some lose some to controversy; and (2) accepting or rejecting royalty claims filed under sections 111, 119, and 1007 on the basis of timeliness or the failure to you win some you lose some the basis for a you win some you lose some. (d) You win some you lose some lyrics and Reimbursement of Arbitration Panels.--The Librarian of Congress, upon the recommendation of the Register of Copyrights, shall you win some you lose some quote the copyright arbitration royalty panels with the necessary win some lose some services win some lose some to proceedings under this chapter, and shall you win some you lose some quote the arbitrators you win some you lose some lyrics in distribution proceedings at such intervals and in such manner as the Librarian shall you win some you lose some quote by regulation. Payments to the arbitrators shall be considered win some lose some costs incurred by the Library of Congress and the Copyright Office for purposes of section 802(h)(1). (b) Damages for Injunctive Relief Wrongfully Obtained.--A seller or distributor who suffers damage by reason of injunctive relief wrongfully obtained under this section has a cause of action against the applicant for such injunctive relief and may win some lose some such relief as may be appropriate, including damages for you win some you lose some lyrics profits, cost of materials, loss of you win some you lose some will, and you win some you lose some damages in instances where the injunctive relief was sought in bad faith, and, unless the you win some you lose some lyrics finds win some lose some circumstances, you win some you lose some quote attorney's fees. 1.
